Acceptance of Terms of Use

This Terms of Use Agreement (the "Agreement") states the terms and conditions under which you may use this website (the "Site"). Please read the Agreement carefully. The Site contains various information relating to Glow Body Studio LLC ("RGV Tooth Co.") in the form of text, graphics, photographs, and other materials, tangible or intangible ("Content"). By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be legally bound by the Agreement. If you do not accept the Agreement, do not use the Site.

RGV Tooth Co. reserves the right to amend the Agreement at any time by posting the amended terms on the Site. Amendments take effect when posted. Your continued use of the Site after amended terms are posted constitutes your acceptance of them.

What These Terms Cover

This Agreement governs your use of the Site only.

The cosmetic services offered by RGV Tooth Co. are governed separately by the intake, consent, and release forms you review and sign before your appointment, together with the booking confirmation you receive by email. Where this Agreement and those signed forms differ with respect to services, the signed forms control.

Nature of Our Services

RGV Tooth Co. provides cosmetic services only. RGV Tooth Co. is not a dental practice, does not diagnose, and does not provide dental or medical services of any kind.

Nothing on the Site is legal, financial, dental, or medical advice, and nothing on the Site creates a professional, fiduciary, or advisory relationship between you and RGV Tooth Co.. Information on the Site is general in nature and is provided for informational purposes only. If you have a question about your oral health, consult a licensed dentist or physician.

Restrictions on Use of Materials

You acknowledge that the Site contains Content protected by copyrights, trademarks, service marks, trade secrets, patents, and other proprietary rights, and that these rights are valid and protected in all forms, media, and technologies existing now and in the future. You also acknowledge that the Content is and shall remain the property of RGV Tooth Co. or of any other party who has been involved in the preparation or publication of the Content (each a "Contributor").

You shall at no time assert any claim of ownership over any Content by reason of your use of the Site, and you shall not grant, create, or permit to exist any lien or other security interest arising from such use. You agree to comply with all copyright and trademark laws.

You may not modify, transmit, participate in the sale or transfer of, or create derivative works based on any Content, in whole or in part, without RGV Tooth Co.'s prior written approval. You may print or save copies of the Content for your own personal, non-commercial use, provided you keep intact any copyright notices, trademark legends, or other proprietary rights notices contained in the Content.

RGV Tooth Co. authorizes you to view and use the Content on the Site solely for your personal, non-commercial use. Republishing the Content on another website, including by framing or mirroring, or in any networked computer environment, is prohibited without RGV Tooth Co.'s prior written approval. Ordinary text links to the Site are permitted.

Booking, Pricing, and Deposits

Appointments booked through the Site are requests to reserve a time and are not confirmed until you receive a confirmation from RGV Tooth Co.. RGV Tooth Co. may decline or reschedule any booking request.

A deposit is required to reserve an appointment. The deposit applies toward the total for your session. Deposits are collected by a third-party payment processor and are subject to that processor's terms in addition to this Agreement.

Prices shown on the Site are current at the time of posting and may change without notice. Not all pricing is published on the Site; pricing for some services is provided directly by RGV Tooth Co.. Pricing shown on the Site is not an offer and does not create a binding contract until a booking is confirmed.

The terms that apply to changing or canceling a confirmed appointment are provided in your booking confirmation.

Eligibility and Minors

The Site is not directed to children under 13, and RGV Tooth Co. does not knowingly collect information from them through the Site.

If you are under 18, you may book an appointment only with the involvement of a parent or legal guardian, who must review and sign the required forms. By booking on behalf of a person under 18, you represent that you are that person's parent or legal guardian and that you agree to this Agreement on their behalf.

Links to Other Sites

As a convenience to you, the Site provides links to third-party websites of entities, organizations, and persons with whom RGV Tooth Co. may or may not associate from time to time ("Third-Party Sites") where we believe you will find such information useful or of interest. While RGV Tooth Co. tries to provide accurate and quality information, our decision to link to a Third-Party Site is not an endorsement of the content of that Third-Party Site. RGV Tooth Co. is not responsible for the content of any third-party website, makes no warranties or representations, express or implied, regarding that content or its accuracy, and shall have no liability of any nature whatsoever in relation to any of the foregoing.

You should take precautions when downloading files from this and all Third-Party Sites to protect your device. If you decide to access linked Third-Party Sites, you do so at your own risk. Once you click a link connecting you to a Third-Party Site, your use of that site and the collection and use of your personal information at that site will be governed by that site's terms of use and privacy policy, and not by the Terms of Use or Privacy Policy of this Site. You should direct any concerns regarding a Third-Party Site to that site's administrator.

Disclaimer of Warranty

You acknowledge and agree that the Site and the Content are provided on an "as is" and "as available" basis. Neither RGV Tooth Co. nor any of its respective owners, officers, employees, or agents (collectively the "RGV Tooth Co. Parties") guarantees the accuracy, completeness, or usefulness of any Content.

None of the RGV Tooth Co. Parties warrants that the Site will be uninterrupted or error-free, or that the Site, its server, or any files available for download through the Site are free of viruses or other harmful elements. You expressly agree that the entire risk as to the quality and performance of the Site, and as to the accuracy or completeness of the Content, is assumed solely by you.

None of the RGV Tooth Co. Parties makes any, and each hereby specifically disclaims any, representations, endorsements, guarantees, or warranties, express or implied, regarding the Site or any Content, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. Without limiting the generality of the foregoing, the RGV Tooth Co. Parties disclaim any warranty as to any results that may be obtained from use of the Site.

Limitation of Liability

Under no circumstances will any of the RGV Tooth Co. Parties be liable for any loss or damage caused by your reliance on information obtained through the Content on the Site, including without limitation any loss or damage caused by your reliance on information obtained from Third-Party Sites to which the Site links. It is your responsibility to evaluate the accuracy, completeness, and usefulness of any information or Content available through the Site.

In no event shall any of the RGV Tooth Co. Parties be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to the Content, the Site, or the Agreement, whether based on warranty, contract, tort, or any other legal theory.

Because some jurisdictions do not allow the exclusion or limitation of liability for negligence or for consequential or incidental damages, in those jurisdictions the liability of the RGV Tooth Co. Parties is limited to the greatest extent permitted by law.

Your sole and exclusive remedy for dissatisfaction with the Site is to stop using the Site.

Trade Dress and Framing

Elements of the Site are protected by trade dress, trademark, unfair competition, and other state and federal laws, and may not be copied or imitated in whole or in part by any means, including through framing or mirroring. No Content from the Site may be retransmitted without the express written consent of RGV Tooth Co..

Termination

RGV Tooth Co. reserves the right, in its sole discretion, to restrict, suspend, or terminate the Agreement and your access to all or any part of the Site or the Content, at any time and for any reason, without prior notice. RGV Tooth Co. reserves the right to change, suspend, or discontinue all or any part of the Site or the Content at any time without prior notice. Termination of your access to the Site does not affect any confirmed appointment or any deposit already paid.

Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into this Agreement by reference.

User Must Comply with Applicable Laws

The Site is based in the State of TX. RGV Tooth Co. makes no claim that the Content may be downloaded or is appropriate for use outside the US. If you access the Site from outside the US, you are solely responsible for compliance with the laws of your jurisdiction.

You agree to use the Content and the Site only for lawful purposes. You are prohibited from any use of the Content or the Site that would constitute an illegal offense, give rise to liability, or otherwise violate any applicable local, state, national, or international law or regulation.

Miscellaneous

If any portion of the Agreement is held to be invalid or unenforceable, that portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the Agreement shall remain in full force and effect.

Paragraph headings are provided for reference only and have no effect on the construction or interpretation of the Agreement. RGV Tooth Co.'s failure to enforce your strict performance of any provision of the Agreement will not constitute a waiver of its right to subsequently enforce that provision or any other provision. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of the Agreement.

The Agreement shall be governed by and construed in accordance with the laws of the State of TX, without regard to its conflicts of law rules. Any action relating to the Content, the Site, or the Agreement must be brought in the federal or state courts located in TX, and you irrevocably consent to the jurisdiction of those courts.

Any cause of action you may have with respect to the Content, the Site, or the Agreement must be commenced within two (2) years after the claim or cause of action arose, or it is barred.

The Agreement contains the entire agreement of the parties with respect to the Site and supersedes all prior oral, written, or other communication between the parties concerning its subject matter.
